What is the difference between mediation and traditional divorce litigation?

Although litigation may be necessary to resolve a complicated legal issue or determine disputed facts that stand in the way of settlement, the parties may have long-lasting negative feelings toward each other from the experience.

Do I need a prenuptial agreement if this is my first marriage?

Not necessarily. Many first marriages succeed without a prenuptial agreement. However, a prenup can be a useful way for couples to discuss financial expectations and make important decisions before marriage.

A prenuptial agreement is not just for second marriages or wealthy individuals. It can help clarify how certain financial issues will be handled and give both parties a better understanding of their rights and responsibilities going forward.

Is mediation right for every divorce situation?

Mediation may be more challenging in cases that involve a history of domestic violence, substance abuse or mental health issues; however, even these challenges do not necessarily exclude the option to mediate. The best case scenario for a mediated divorce is for couples ending their relationship who want to remain amicable and minimize the court’s role in their divorce. For people who are motivated to find common ground, a mediator is often the right decision.

How long does the divorce process take in Arizona?

Arizona law requires a minimum 60-day waiting period after the divorce papers are served, but there is no standard timeline that applies to every case. The length of a divorce depends on the issues involved, the complexity of the assets and parenting arrangements, and the parties’ ability to reach agreements. In general, cases tend to move more quickly and cost less when both sides focus on problem-solving rather than conflict. When parties are unable to move past anger or remain focused on past grievances, resolving the case often becomes more time-consuming, expensive, and emotionally draining.
